NIL Policies
The NAIA does not have different NIL policies per state. Instead, the NAIA has implemented a uniform, association-wide NIL policy that applies to all its member institutions and student-athletes across the country.
The NAIA was actually the first college sports association to pass NIL legislation, doing so in October 2020. This predates the NCAA's interim policy, which came into effect in July 2021.
The NAIA's NIL policy is outlined in its Amateur Code, which allows student-athletes to receive compensation for promoting commercial products, enterprises, or for making public or media appearances.
Unlike the NCAA, which requires athletes to follow state laws where applicable, the NAIA's policy appears to be consistent across all states.
NAIA student-athletes can benefit from their name, image, and likeness without violating their amateur status, as long as they comply with the NAIA's guidelines
To summarize, the NAIA does not have state-specific NIL policies. Instead, it has implemented a uniform policy that applies to all NAIA institutions and student-athletes, regardless of their location. This approach differs from the NCAA's state-by-state model and provides more consistency for NAIA student-athletes across the country.
